City of Chesapeake ADU rules — what you can build and when.

Chesapeake allows a guesthouse — not, today, an independent dwelling.

Detached ADUs today
Chesapeake does not permit a full detached accessory dwelling unit by-right. The only detached secondary living structure authorized under Article 14 is a guesthouse or servants' quarters, which is expressly not an independent dwelling.
Size cap
There is no ADU-specific square-footage cap. Accessory structures are limited to 75% of the principal building's lot coverage, combined with the district maximum.
Occupancy rule
The guesthouse may house occasional guests, relatives or domestic employees only. It may not be rented or used for permanent independent dwelling occupancy, and it may not contain a kitchen or food-preparation facilities. The lot must be zoned single-family and be at least 20,000 sq ft.
Utility notes
Chesapeake Bay Preservation Act Resource Protection and Management Areas, plus floodplain zones toward the Great Dismal Swamp, materially restrict where an accessory structure can sit.
What SB 531 changes
Chesapeake has further to travel than almost any Hampton Roads jurisdiction. A no-kitchen guesthouse is not an accessory dwelling unit, so the city will need a new provision to satisfy SB 531 by July 1, 2027.
The Detail

Reading between the lines.

It's important to be precise about Chesapeake: what the ordinance permits is a guesthouse, not an ADU. Under Article 14 the structure may not contain a kitchen or food-preparation facilities, may not be rented, and may not be used for permanent independent dwelling occupancy. That is a fundamentally different product from a backyard home.

The threshold is high as well — the lot must be zoned single-family and be at least 20,000 sq ft, which excludes a large share of the city's housing stock. Virginia's temporary family health care structure statute (Va. Code §15.2-2292.1) offers a narrow, health-need-based exception, but it is temporary by design.

Chesapeake's environmental overlays compound the zoning picture. CBPA Resource Protection Areas and floodplain zones cover meaningful portions of the city and restrict accessory structure siting independent of the use question. For most Chesapeake homeowners, SB 531's July 1, 2027 effective date is the realistic starting line — and that makes now the right time to design and site the project.
