Albemarle County today permits interior accessory apartments by-right — the classic finished-basement or over-garage unit — capped at 35% of the primary dwelling's gross floor area, with owner-occupancy required. Detached backyard cottages are currently prohibited.
SB 531 changes both. On July 1, 2027, Albemarle must permit a detached ADU by-right on every single-family lot in the county, and the owner-occupancy requirement is preempted. For Charlottesville-area homeowners this is a substantial shift — the county goes from an interior-only regime to permitting stand-alone cottages county-wide.
Utility mix here spans the Charlottesville urban service area (public water and sewer) and outlying rural districts on septic. On rural parcels, health-department review is the pacing item, as elsewhere in Piedmont Virginia.
