Fauquier County is a rural-friendly jurisdiction on accessory dwellings. In most residential and rural districts, homeowners can already add one accessory dwelling per single-family home — including a detached unit — subject to size and bedroom caps.
Typical size limits run to about 800 sq ft, with room to grow to roughly 1,000 sq ft on lots of five acres or more. A two-bedroom limit is common. Because nearly all Fauquier parcels are on septic rather than public sewer, health-department review is the pacing item — septic capacity, drainfield location, and reserve area drive both feasibility and cost.
SB 531 doesn't fundamentally rewrite Fauquier's approach, but it locks in the $500 permit-fee cap, guarantees setback parity, and cleans up the remaining owner-occupancy and family-relation restrictions in specific districts.
